1. Introduction

By accessing or using the services, including this website and associated apps (collectively, "the Service") provided by DreamGen, you are entering into a legally binding contract governed by these Terms of Service ("the Terms"). Your agreement to these Terms is required to access or use the Service.

While the Service provides tools for creating, sharing, and distributing content, including adult themes, nudity, violent, or explicit content, you agree not to generate content that would be considered illegal in the United States, the countries of the European Free Trade Association, or in your own country.

4. Intellectual Property

You retain ownership of any content you generate using the AI models provided by the Service and may distribute this content freely, within the boundary of intellectual property laws. You grant the Service an unrestricted, worldwide, royalty-free license to use, modify, display, and distribute your content.

5. License

By using the Service and electing to share your content, you grant us a license to use, reproduce, distribute, modify, publicly perform, publicly display, and create derivative works of your content, both in connection with the Service and other business efforts, such as marketing. This includes but is not limited to using the content for improving our AI models, quality control, moderation, and displaying your content on various properties of the Service, such as our websites and applications. This license is worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable. By choosing to share your content with the Service, you affirm that you have the necessary rights and permissions to grant us this license.

6. Subscription and Payment

All purchases are final and non-refundable, except at the discretion of the Service. You are responsible for managing your subscription, which can be done via the account management page or by contacting us at support@dreamgen.com.

We make no guarantees regarding the continuous availability of our models. Due to reasons, which may include but are not limited to, system maintenance, updates, technical faults, or external impacts, such models may become temporarily or permanently unavailable. In such cases, we are not obligated to provide refunds, though we may do so at our discretion.

It is especially likely for our alpha and beta models to become temporarily or permamnently unavailable, or to experience other disruptions.

7. Account Termination

We reserve the right to suspend or terminate your account or access to the Service at any time, for any reason. Breaches of these Terms, including the generation or distribution of prohibited content, could result in immediate suspension or termination of your access to the Service.

8. Warranties and Representations

By using the Service, you warrant that you have the legal right to do so, that you will use the Service for lawful purposes only, and that you will comply with these Terms, as well as all applicable laws and regulations.

9. Liability Disclaimer

The Service is provided "as is," without guarantees, representations, or warranties of any kind, either express or implied, other than those specifically stated in these terms. The Service assumes no liability for any losses or damages arising either directly or indirectly from your use or inability to use the Service, irrespective of the cause or reason for the disruption. This includes, but is not limited to, any potential loss of income, data, or other intangible losses, even if the Service has been notified of the possibility of such damages.

10. Service Availability

While DreamGen strives to provide reliable, constant access to our AI models, we do not guarantee their continuous availability or performance. Models may become unavailable or unreliable due to various reasons, such as maintenance, updates, or circumstances beyond our control. DreamGen, its directors, officers, employees, or affiliates are not liable for any damages resulting from the unavailability or unreliability of these models.

It is especially likely for our alpha and beta models to become temporarily or permamnently unavailable, or to experience other disruptions.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Service and its officers, directors, employees, and agents from any claims or disputes that arise out of your negligence or violation of these Terms.

12. Changes to Terms of Service

We reserve the right to modify or update these Terms at any time, with the 'effective' date located at the top of this page. It is your responsibility to periodically check this page for any revisions. Your continued use of the Service after any changes have been posted signifies your agreement to the updated Terms.
